Kicklaws Website Terms and Conditions (T&Cs)

1. General Provisions

1.1. Parties to the Agreement: These Terms and Conditions (T&Cs) govern the relationship between Kicklaws (hereinafter, the "Service Provider" or "We") and any person who registers for or uses the website www.kicklaws.com (hereinafter, the "User" or "You").

1.3. Applicable Law and Jurisdiction: This Agreement is governed exclusively by Swiss Law. The exclusive place of jurisdiction for any dispute arising from or in connection with these T&Cs is Geneva, Switzerland.
1.4. Acceptance of Terms: By registering an account, casting a vote, submitting a proposal, or otherwise using the Service, You expressly acknowledge that You have read, understood, and accept these T&Cs and the accompanying Privacy Policy in their entirety.

2. User Accounts and Eligibility

3. Use of the Service and Voting Integrity

3.1. Voting Integrity: You agree to only cast one (1) vote per proposal and will not use any means (e.g., automated scripts, multiple accounts, false identities) to manipulate the voting results or undermine the integrity of the platform.
3.2. Prohibited Conduct You agree not to use the Service to: * Engage in unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable conduct. * Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity. * Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. * Introduce any malicious software, viruses, or code designed to interrupt, destroy, or limit the functionality of the Service.
3.3. Right to Refuse/Remove Content: The Service Provider reserves the right, but not the obligation, to review, reject, or remove any User-submitted content (including comments and proposals) that violates these T&Cs or is deemed inappropriate, in its sole discretion.

4. User-Submitted Content and Proposals

4.1. Ownership: You retain all intellectual property rights in, and are responsible for, the content and proposals You submit to the Service.
4.2. License Grant: By submitting content (including text, comments, and proposal ideas) to the Service, You grant Kicklaws a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, display, and modify that content in connection with the operation of the Service and its promotion.
4.3. Warranties on Submissions: You warrant that You own or have the necessary licenses, rights, consents, and permissions to publish the content You submit.

5. Intellectual Property Rights

5.1. Kicklaws Property: All materials on the Kicklaws website, including but not limited to the design, text, graphics, logos, and software, are the exclusive property of Kicklaws or its licensors and are protected by Swiss and international intellectual property laws.
5.2. Restrictions: You may not copy, reproduce, or distribute the proprietary content of the Service Provider without prior written permission.

6. Disclaimer of Warranties and Limitation of Liability

6.1. Accuracy of Information: The Service Provider makes every reasonable effort to ensure the accuracy of the information regarding proposed laws or topics but offers no guarantee of its completeness or correctness. The Service is provided "as is" and "as available" without warranty of any kind
6.2. Limitation of Liability: To the maximum extent permitted by Swiss law, the Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from (a) Your access to or use of the Service; (b) any conduct or content of any third party on the Service; or (c) any unauthorized access, use, or alteration of Your transmissions or content. This exclusion does not apply in cases of gross negligence or willful intent.

7. Termination

8. Amendments to Terms

By continuing to access or use our Service after those revisions become effective, You agree to be bound by the revised terms.
